LIBERTAD DE TRÁNSITO Resumen: El presente artículo abordará la limitación al derecho constitucional del libre tránsito en el marco de un peligro inminente, analizando el caso particular de las erupciones del volcán Poás ocurridas en el año 2017. Asimismo, se analizará la resolución de la Sala Constitucional número 2017014546 del 12 de setiembre de 2017. Mediante la cual se resolvió el recurso de habeas corpus presentado por tres miembros de la Familia Barquero, ante el anillo de protección establecido por la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE) basado en el criterio técnico del Comité Asesor Técnico de Vulcanología y Sismología. This article will address the limitation to the constitutional right of free transit within the framework of an imminent danger, analyzing the particular case of the eruptions of the Poás volcano that occurred in 2017. Likewise, the resolution of the Constitutional Chamber number 2017014546 of 12 of September 2017. Whereby the appeal of habeas corpus presented by three members of the Barquero Family was resolved, before the protection ring established by the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE) based on the technical criteria of the Technical Advisory Committee of Volcanology and Seismology.
